• <br /> 4z...A <br /> ORDINANCE NO. as/O— 9t EVERETT <br /> AN ORDINANCE amending Ordinance No. 1418-87, "General Utility <br /> Taxes," adding a paragraph 4 to Section 1B that Cellular Telephone Service <br /> is to be included in the General Utility Tax Requirements for the City of <br /> Everett. <br /> WHEREAS, the City of Everett, in the exercise of its tax powers deems it necessary and <br /> advisable to impose a tax upon certain business activities in the City of Everett; <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance No. 1418-87 which reads as follows: <br /> Section 1: BUSINESS SUBJECT TO UTILITY TAXES. There is hereby levied and <br /> shall be collected an excise tax on account of the business activities described herein, and <br /> in the amounts to be determined by the application of the rates against gross income, as <br /> follows: <br /> A. Upon every person engaged in or carrying on a telegraph business a tax <br /> equal to five and three quarters percent (5.75%) of the total gross income from <br /> such business in the City of Everett during the fiscal year next preceding the tax <br /> year, whichever is greater. This tax shall be paid annually, on or before the 15th <br /> day of February of each year. <br /> B. Upon every person engaged in or carrying on a telephone business, a tax <br /> equal to five and three quarters percent (5.75%) of the total gross operating <br /> revenues, including revenues from intrastate tolls, derived from the operation of <br /> such business within the City of Everett, which shall be paid monthly on or before <br /> the 20th day of the following month. <br /> 1. Gross operating revenues for this purpose shall not include charges <br /> which are passed on to the subscribers by a telephone company pursuant to <br /> tariffs required by regulatory order to compensate for the cost to the <br /> company of the tax imposed by this ordinance. <br /> 2. "Telephone business" means the business of providing access to a <br /> local telephone network, local telephone network switching services, toll <br /> service, or coin telephone services, or providing telephone, video, data, or <br /> similar communication or transmission for hire, via a local telephone <br /> network, toll line or channel, or similar communication or transmission <br /> system. It includes cooperative or farmer line telephone companies or <br /> associations operating an exchange. "Telephone business" does not <br /> include the providing of competitive telephone services, not the providing <br /> of cable television services. <br />
