ORD INANCE NO . 2007-94 AN ORDINANCE amending Ordinance No. 1224-86 providing for single family subdivision with single family detached dwellings for the area generally described as West Mall Drive, north and east of 92nd Street S .E. , Everett WHEREAS, Ordinance No. 1224-86 amended the Zoning Map rezoning the following area from R-1 to R-3 with concomitant agreement: Parcel No. 18-28-05-1-019 Section 18, Township 28, Range 5 East W.M. , that portion of the SW 1\4 of the NE 1\4 lying westerly of P.N.T. Co. R\W ; and WHEREAS, on December 12, 1990, an addendum to the concomitant agreement was authorized permitting condominium apartments and homes for older persons; and WHEREAS, the property owner for the subject property has requested a further amendment to the concomitant agreement authorizing, as an option, that the property be developed as a single family subdivision with single family detached dwellings on individual lots; and WHEREAS, the Hearing Examiner has approved the request and recommends to City Council the approval of the amendment to the concomitant agreement; NOW, THEREFORE , the City of Everett does ordain: Section 1 : Section 5 of Ordinance No. 1224-86 adopted by reference a concomitant agreement for the rezone. Section 5 of Ordinance No. 1224-86 is hereby amended by the adoption of Exhibit "1, " an addendum to the concomitant agreement, which is attached hereto and incorporated herein by reference .
