--,Ip ' ORDINANCE NO.7GY5 9� EYERETT AN ORDINANCE providing for the vacation of a portion of Broadway, east of 5400 Block, south of Gale Place. WHEREAS, the City Council of the City of Everett, did by Resolution No. 3914 duly adopt and fix the 23rd day of March, 1994, at 8:30 A.M., as the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, the City Council finds it would not vacate the street could it not retain an easement; and WHEREAS, it now appears to the City Council of the City of Everett that the said street resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: BEGINNING AT THE SOUTHWESTERLY CORNER OF LOT 46, PLAT OF LOWELL VIEW TRACTS, ACCORDING TO THE PLAT THEREOF RECORDED IN VOLUME 10 OF PLATS, PAGE 96, RECORDS OF SNOHOMISH COUNTY, WASHINGTON; THENCE SOUTH 03 DEGREES 18 MINUTES 55 SECONDS EAST, ALONG THE EASTERLY RIGHT OF WAY OF BROADWAY, A DISTANCE OF 48.40 FEET; THENCE NORTH 86 DEGREES 19 MINUTES 34 SECONDS WEST A DISTANCE OF 37.27 FEET; THENCE NORTH 03 DEGREES 13 MINUTES 42 SECONDS WEST ON A LINE THAT IS 50.00 FEET EASTERLY OF THE CENTERLINE OF BROADWAY, A DISTANCE OF 208.75 FEET; THENCE NORTH 86 DEGREES 46 MINUTES 18 SECONDS EAST A DISTANCE OF 29.38 FEET TO A POINT THAT BEARS NORTH 05 DEGREES 51 MINUTES 00 SECONDS WEST FROM THE POINT OF BEGINNING; THENCE SOUTH 05 DEGREES 51 MINUTES 00 SECONDS EAST, ALONG THE WESTERLY LINE OF LOTS 44 THROUGH 46 A DISTANCE OF 165.00 FEET TO THE POINT OF BEGINNING. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. 1
