subsection, "premises" includes real property, houses, buildings, <br /> and other structures, motor vehicles and motorcraft. <br /> B. It is a misdemeanor, punishable by a fine of not more than one <br /> thousand dollars, for any person under the age of twenty-one <br /> years, to acquire, drink, consume or possess liquor, or to have <br /> consumed liquor and be or remain within the city limits of Everett. <br /> C. It is a misdemeanor, punishable by a fine of not more than one <br /> thousand dollars, for any person under the age of twenty-one <br /> years to be in a public place, or to be in a motor vehicle in a public <br /> place, while exhibiting the effects of having consumed liquor. For <br /> purposes of this subsection, exhibiting the effects of having <br /> consumed liquor means that a person has the odor of liquor on his <br /> or her breath and either: (i) is in possession of or close proximity <br /> to a container that has or recently had liquor in it; or (ii) by <br /> speech, manner, appearance, behavior, lack of coordination, or <br /> otherwise, exhibits that he or she is under the influence of liquor. <br /> D. The provisions of this section shall not apply in the case of <br /> liquor given or permitted to be given to a person under the age of <br /> twenty-one years by his or her parent or guardian for beverage or <br /> medicinal purposes, or administered to him or her by his or her <br /> physician or dentist for medicinal purposes, or when such liquor is <br /> used in connection with religious services. <br /> Section 2: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase <br /> of this ordinance or its application to any person or situation be <br /> declared unconstitutional or invalid for any reason, such decision shall <br /> not affect the validity of the remaining portions of this ordinance or its <br /> application to any other person or situation. The City Council of the <br /> City of Everett hereby declares that it would have adopted this <br /> ordinance and each section, subsection, sentence, clause, phrase or <br /> portion thereof irrespective of the fact that any one or more sections, <br /> subsections, clauses, phrases or portions be declared invalid or <br /> unconstitutional. <br /> Section 3: Third Party Liability <br /> It is expressly the purpose of this ordinance to provide for and promote <br /> the health, safety and welfare of the general public and not to create <br /> or otherwise establish or designate any particular class or group of <br /> 2 <br />
