• OIP A. ORDINANCE NO. 1994-94 I/Ef2ETT AN ORDINANCE providing for the vacation of a portion of the northeast corner of the intersection of 112th St. S.W. and Paine Field Way. WHEREAS, the City Council of the City of Everett, did by Resolution No. 3842 duly adopt and fix the 27th day of October, 1993, at 8:30 A.M., as the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, the City Council finds it would not vacate the street could it not retain an easement; and WHEREAS, it now appears to the City Council of the City of Everett that the said street resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: A PORTION OF PAINE FIELD WAY(SILVER LAKE ROAD)ADJOINING 112TH STREET S.W. (PAINE FIELD ACCESS ROAD)IN THE PLAT OF PAINE FIELD ADDITION NO. TWO AS RECORDED IN VOLUME 19, PAGE 92 RECORDS OF SNOHOMISH COUNTY, WASHINGTON, ALL WITHIN SECTION 23, TOWNSHIP 28 NORTH, RANGE 4 EAST, W.M. DESCRIBED AS FOLLOWS: BEGINNING AT THE WESTERLY MOST CORNER OF LOT 34; THENCE SOUTH 39 DEGREES 58' 40" EAST ALONG THE NORTHEASTERLY MARGIN OF PLATTED SILVER LAKE ROAD(PAINE FIELD WAY) A DISTANCE OF 46.98 FEET TO A POINT OF CURVATURE OF SAID LOT 34 AND TRUE POINT OF BEGINNING; THENCE CONTINUING SOUTH 39 DEGREES 58'40" EAST ALONG THE SOUTHEASTERLY EXTENSION OF SAID RIGHT OF WAY MARGIN, A DISTANCE OF 223.52 FEET TO THE INTERSECTION OF THE WESTERLY EXTENSION OF THE NORTH MARGIN OF 112TH STREET S.W. (PAINE FIELD ACCESS ROAD); THENCE SOUTH 89 DEGREES 23'50" EAST ALONG SAID WESTERLY EXTENSION OF SAID RIGHT OF WAY A DISTANCE OF 120.97 FEET TO A POINT OF CURVATURE IN THE SOUTHERLY LINE OF LOT 35 OF SAID PLAT, FROM WHICH THE CENTER POINT OF SAID CURVE BEARS NORTH 16 DEGREES 12'08" EAST A DISTANCE OF 542.96 FEET; THENCE NORTHWESTERLY ALONG THE SOUTHERLY LINES OF LOTS 34 AND 35, ALONG SAID CURVE BEING TO THE RIGHT, THROUGH A CENTRAL ANGLE OF 33 DEGREES 49'15" AN ARC DISTANCE OF 320.50 FEET TO THE POINT OF TANGENCY AND TRUE POINT OF BEGINNING. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. 1
