<br /> WHEREAS,Grantor is the owner of certain real property("Property'herein)In the County of
<br /> Snohomish,
<br /> State of Washington,described as follows:
<br /> The East 440 feet of that portion of Government Lot 5 In the Southeast
<br /> Quarter of Section 19, Township 28 North, Range 5 East, Willamette
<br /> Meridian lying Westerly of the easterly margin of 14th Ave.SE(as described
<br /> In that certain Instrument recorded under Auditor File Number 1660106),
<br /> Lying Northwesterly of the southeasterly margin of Silver Lake Road,each
<br /> as shown on that certain survey recorded under Snohomish County,
<br /> Washington Auditor File Number 9607165004, AND Lying Southerly of
<br /> 112th Street SE.
<br /> SITUATE IN THE ABOVE-DESCRIBED SNOHOMISH COUNTY,WASHINGTON

<br /> AND WHEREAS, the Grantee is desirous of acquiring certain rights and privileges
<br /> across,under and upon said Property.
<br /> NOW,THEREFORE,Grantor,for and in consideration of the sum of One Dollar($1.00)
<br /> and other valuable consideration, receipt of which Is hereby acknowledged,hereby conveys
<br /> and grants to Grantee,its agents,contractors,successors and assigns,the nonexclusive
<br /> perpetual right, privilege, and authority to construct, erect, alter, improve, extend, repair,
<br /> operate, and maintain underground electric distribution line facilities consisting of conduits,
<br /> cables, lines, vaults, switches and transformers, communication lines, fiber optic cables,
<br /> semi-buried and ground mounted facilities and pads and any other necessary or convenient
<br /> appurtenances,across,under and upon that portion of the Property("Easement Area"herein)
<br /> described as follows situated in the County of Snohomish,State of Washington,to-wit:
<br /> That portion of the above-described property lying within a strip of land 10.00 feet
<br /> In width,having 5.00 feet of such width on each side of the centerline of Grantee's
<br /> as-constructed electrical facilities approximately as shown on Exhibit A attached
<br /> hereto and by this reference made a part hereof.
<br /> Existing improvements, access, landscaping and parking are not inconsistent
<br /> with the rights granted herein.
<br /> Together with the right of ingress to and egress from said easement area across
<br /> adjacent lands of the Grantor, for the purpose of constructing, reconstructing, repairing,
<br /> renewing,altering,changing,patrolling and operating said facilities,and the right at any time
<br /> to remove said facilities from said lands.
<br /> Also the right at all times to cut and/or trim all brush, timber, trees or other growth
<br /> "J standing or growing upon the property of Grantor which, in the opinion of Grantee, is
<br /> l necessary for the operation and maintenance of Grantee's facilities and/or constitute a
<br /> menace or danger to said facilities or to persons or property by reason of proximity to said
<br /> line. Provided that Grantor reserves the right to use the lands of said easement area for
<br /> any purposes not a hazard to the said underground electric distribution line facilities or
