The Quit Claim Deed conveying the property to the new owner contained restrictions related to the <br /> use and development of the property as set forth in Exhibit"A"which was attached to the Quit Claim Deed. <br /> The restrictions defined under Exhibit"A"were intended to insure that future use and development of the <br /> property would be consistent with the C-2 ES (Heavy Commercial-Light Industrial Everett Station) zoning <br /> district and also provided for limited access points to the site. <br /> The owner is seeking to demolish the existing metal building structure and redevelop the site with an <br /> approximately 11,700 square foot mixed use building consisting of retail, office,warehouse, live/work space, <br /> and parking. The new development proposes to utilize an existing driveway access from Cedar Street which <br /> is in conflict with the restrictions as defined under Exhibit"A" of the Deed. The City's Planning, Public <br /> Works, and Traffic Engineering Departments have reviewed the proposed development and its consistency <br /> with the intent of the C-2 ES zoning standards and the proposed use of the existing access from Cedar Street <br /> and are supportive of the proposed Amendment. <br /> RECOMMENDATION (Exact action requested of Council): <br /> Authorize the Mayor to execute the Amendment to Property Use and Restrictive Covenants on former City <br /> owned property located at 2917 Pacific Ave. <br /> d <br /> 17 <br />
