10. A recreation easement for limited recreational purposes will be provided for the detention <br /> vault's cover allowing the subdivision's residents limited access to Tract 998 for said <br /> purposes. (SEPA Land Use Policies) <br /> 11. Perimeter landscaping will be required for surface ponds and basins. Landscaping shall <br /> be consistent with the site and landscape plans on file with the City Planning/Community <br /> Development Department. A detailed landscape plan must be submitted and approved <br /> during plan review. Landscaping shall be provided outside of the high water mark and <br /> may be required to be included in a separate tract under common ownership. Installation <br /> of the landscaping per the approved plan is required before final approval. The City will <br /> require formation of a Homeowner's Association to maintain all landscape areas. Note <br /> this plan will also need to be reviewed by the City Planning Department. (SEPA <br /> Aesthetics Policy) <br /> 12. The Mukilteo School District has commented that the project will adversely impact the <br /> School District. The Applicant negotiated a voluntary mitigation agreement with the <br /> School District(letter of 2/11/98). Prior to final plat approval, the Applicant shall fulfill <br /> all terms of the agreement, which includes payment of fees, and shall provide a receipt to <br /> the City Planning Department showing such payment has been made. (SEPA Public <br /> Services and Utilities Policies) <br /> 13. The traffic mitigation fee of$8,800 is required prior to final plat approval. (SEPA <br /> Transportation Policy) <br /> 14. A permanent fence must be constructed along the entire edge of the environmentally <br /> sensitive area(ESA) buffer. The design of the fence shall be split rail, or an alternative <br /> approved by the City Planning Department prior to issuance of permits. City of Everett <br /> ESA signs must be placed at approximately 50 foot intervals along the fence. The signs <br /> are available from the City Planning and Community Development Department. (SEPA <br /> Earth, Plant and Animal, and Land and Shoreline Use Policies) <br /> 15. Prior to final approval,the Applicant shall analyze potentially hazardous trees on the site. <br /> All such trees must be removed and replanted with native evergreens at a replacement ratio <br /> of 2:1. The City may require a report from a certified arborist. (SEPA Plants and Animals <br /> Policies) <br /> TIME LIMITS - Within a period of three years following the approval of the preliminary <br /> development plan and adoption of this Resolution of Intent to Rezone by City Council,the <br /> applicant shall file with the Planning Department a final development plan consistent with this <br /> agreement. The Director, for good cause,may extend for one year the period for filing of the <br /> final development plan. . <br /> If the applicant fails to apply for final approval for any reason within the time specified in <br /> Subsection 32.160 of the Zoning Code,the Resolution of Intent to Rezone shall be void.
