C. It is the intent of the City Council to rezone property located on the southeast <br /> corner of 19th Avenue SE and 124th Street SE, a vicinity map of which is <br /> attached hereto as Exhibit "A," from R-2 to R-3 (Multiple Family Medium <br /> Density), pursuant to the provisions of Section 41.160 of Ordinance No. 1671-89, <br /> as amended, and the Council shall by ordinance effect such rezone upon being <br /> advised that all of the following conditions, stipulations, limitations, and <br /> requirements contained in this Resolution have been met: <br /> 1) The number of dwelling units allowed by the development of the subject <br /> property shall be limited through the City's SEPA process to the lesser of the <br /> following: <br /> (a) 200 dwelling units; or <br /> (b)the maximum number of dwelling units allowed by the zoning <br /> regulations for the R-3 zone in effect at the time of application for site plan <br /> approval. <br /> 2) The Planning Director shall determine at the time of application for <br /> development and SEPA approval for the subject property if the character and <br /> quality of the development proposed is similar in quality and character to that <br /> represented by the applicant in exhibits submitted to the Planning Commission at <br /> the October 21, 1997,public workshop and the slides displayed at the Planning <br /> Commission public hearing on November 18, 1997. Similar in quality and <br /> character shall not mean identical to the developments depicted at said Planning <br /> Commission meetings, but shall refer generally to the quality and character of <br /> those projects. If the Planning Director determines that the quality and character of <br /> development proposed is not commensurate with said exhibits,the Planning <br /> Director shall provide the applicant with a written itemization of the aspects of the <br /> plans which will need to be revised. The requirement for revision shall not affect <br /> the completeness of the application if the application meets all requirements for a <br /> complete application as defined in Ordinance No. 2136-96 and amendments <br /> thereto. The written itemization shall be a request for additional information <br /> required in order for the City to continue to process the development application. <br /> As provided for in Section 4.J.1 of said Ordinance No. 2136-96,the 120 day time <br /> period for completing the Notice of Decision shall not include the period from the <br /> Director's request for additional information to the date the requested information <br /> has been submitted to the Director. The Director may include conditions and <br /> requirements in the Notice of Decision as deemed necessary to require the quality <br /> and character of development to be consistent with that represented to the Planning <br /> Commission. <br />
