Appendix 6 <br /> Laws and Plans Supporting Bicycle and Pedestrian Transportation <br /> At the federal level, passage of the Intermodal Surface Transportation Efficiency Act(ISTEA) <br /> has been the most far reaching law supporting bicyclists and pedestrians. At the state level, <br /> several laws and policies exist that support bicycling and pedestrian use of the transportation <br /> system. Rather than provide a detailed summary of each law and plan, a listing of key laws and <br /> plans are provided to illustrate the magnitude of support for bicyclists and pedestrians. The laws <br /> and plans are listed according to their commonly known name. <br /> LAWS <br /> • ISTEA-Section 1025—The primary section on bicycling and walking, and requires <br /> bicycling and walking to be included as part of the state transportation system. <br /> • ISTEA-Congestion Mitigation and Air Quality Improvement Program—Program provides <br /> funds for projects and activities to reduce congestion and contribute to achieving National <br /> Ambient Air Quality Standards. Bicycle and pedestrian projects are eligible for funding <br /> under this program. <br /> • RCW 47.06—Requires Washington's Transportation Plan. <br /> • Growth Management Act—Requires bicycling to be included in comprehensive plans, <br /> provides density bonuses, etc., that are supportive of a pedestrian environment. <br /> • Commute Trip Reduction Act—Companies with more than 100 employees are required to <br /> reduce single occupant commute trips, thus forcing a shift to transportation alternatives, <br /> including bicycling and walking. <br /> • RCW 47.30-Paths and Trails—Sets aside funding for bicycle and pedestrian paths and <br /> trails and requires the replacement of paths and trails if they are obstructed by another <br /> transportation project. Also has minimum funding requirements, which are approximately <br /> $1.5 million annually at the state level and $700,000 total for cities and counties. <br /> • RCW 39.92-Local Transportation Act—Enables local governments to develop public and <br /> private partnerships to fund transportation improvements, including bicycle and pedestrian <br /> facilities. <br /> • RCW 35.68 and 35.69—Permits cities to create a sidewalk construction fund and can <br /> require abutting property owners to put in sidewalks. <br /> W:\PLANNING\TRAILS\COMP96.DOC 52 <br />
