e 4. The building is unsafe for dwelling purposes. 5. The building is in such a condition as to constitute a public nuisance known to the common law or in equity jurisprudence. 6. The building is a nuisance to the health, safety, and welfare of the public, and inquisitive minors in the area. 7. In its present condition, the building endangers the health, safety, and welfare of the public, and inquisitive minors in the area. WHEREAS, the City Council finds that the above stated conditions of said buildings endanger the life, health, property, and safety of the public and occupants of the buildings; and WHEREAS, the City Council finds that the buildings constitute dangerous buildings under the Uniform Code for the Abatement of Dangerous Buildings and substandard buildings under the Uniform Housing Code; and WHEREAS, the City Council finds that the owner has been given notice of this Council meeting; and WHEREAS, the City Council finds that it is imperative that immediate action be taken to abate the building; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT that: Section 1: That the building located at 3402 Colby Ave., Everett, Washington, are legally described as follows: Lots 31 and 32, Block 823, Everett Division A to Everett, as per plat recorded in Volume 3 of Plats, page 61, records of Snohomish County; Situate in the County of Snohomish, State of Washington. Section 2: That the building on the above-described property is hereby declared to be dangerous as defined in the Uniform Code for the Abatement of Dangerous Buildings, and substandard as defined in the Uniform Housing Code. Section 3: That the building located on the property described herein creates an immediate danger to the life and/or safety of the public unless the action described herein occurs and, therefore, an emergency is hereby declared. 2
