• <br /> 10 <br /> proposal, the City will comply according to the Open Public Records Act, Chapter 42.17 RCW. If any <br /> information is marked as proprietary in the proposal, such information will not be made available until the <br /> affected firm has been given an opportunity to seek a court injunction against the requested disclosure.. <br /> I. Response Property of the City Of Everett <br /> All materials submitted in response to this RFP become the property of the City. Selection or rejection of a <br /> proposal does not affect this right. <br /> J. Rejection of Proposals <br /> Only firm proposals will be accepted, and the City reserves the right to reject any or all proposals or waive <br /> any irregularities and informalities in the proposals submitted and accepted by the City. The City further <br /> reserves the right to make awards to the responsible offer or whose proposal is determined to be the most <br /> advantageous to the City of Everett. The issuance of this RFP does not compel the City to enter into a <br /> contract with any proposer. <br /> K. Cost of Preparing Proposals <br /> The City of Everett is not liable for any costs incurred by firms in the preparation and presentation of <br /> proposals in response to this RFP. <br /> L. Number of Proposal Copies Required <br /> Firms responding to this RFP are to submit one (1) original and four (4) identical copies of the complete <br /> proposal package.An electronic copy of the proposal in either Adobe Acrobat or Microsoft Office 2003 <br /> compatible formats must also be submitted. <br /> M. Errors in Proposal <br /> The City will not be liable for any errors in proposals. Firms will not be allowed to alter proposal <br /> documents after the deadline for proposal submission. <br /> The City reserves the right to make corrections or amendments due to mathematical or typographical errors <br /> identified in proposals by the City or the firm. This type of correction or amendment will only be allowed <br /> for such errors as typographical, numerical transposition or any other reasonable and obvious errors. Firms <br /> are liable for all errors or omissions contained in their proposals. <br /> When, after the opening and tabulation of proposals, a selected proposer claims error and requests to be <br /> relieved of award, he will be required to promptly present certified work sheets. The City will review the <br /> work sheets, and if the City is convinced, by clear and convincing evidence, that an honest, mathematically <br /> plausible error or critical omission of costs has been made, the proposer may be relieved of his proposal. <br /> After opening and reading proposals, the City will check them for correctness of extensions of the prices <br /> per unit or subtotal and the total price. If a discrepancy exists between the price per unit or subtotal and the <br /> extended amount of any proposal item, the price per unit will control. The total of extensions, corrected <br /> where necessary, will be used by the City. <br /> N. Incorporation of RFP and Proposal in Agreement <br /> The RFP, including all attachments and addenda, and all promises, warranties, commitments and <br /> representations in the successful proposal shall be binding and shall become obligations of an agreement <br /> between the successful proposer and the City. <br /> 44 <br /> 2008-093—RFP, Banking Services 6 of 28 <br />
