1. There is no other reasonable use or feasible alternative to the proposed <br /> development with less impact on the environmentally sensitive area; and <br /> 2. The proposed development does not pose a threat to the public heaith, safety and <br /> welfare on or off of the subject lot; and <br /> 3. Any alterations permitted to the requirements of this Ordinance shall be the <br /> minimum necessary to allow for reasonable use of the property; and <br /> 4. The inability of the applicant to derive reasonable economic use of the property is <br /> not the result of actions by the applicant in subdividing the property or adjusting a <br /> boundary line thereby creating the undevelopable condition after the effective date <br /> of this Ordinance; and <br /> 5. The proposal mitigates the impacts ori the environmentally sensitive areas to the <br /> maximum extent possible. <br /> Tfie Planning Director's conclusions are as follows: <br /> 1. There is no other reasonable use or alternative to the proposed development witF, <br /> less impact upon the environmentally sensitive area. The R-1 zone allows a single <br /> family residence upon a minimum lot size of 6,000 square feet. The proposed <br /> residence is being located oriy 6 feet from the front property fine to help minimize <br /> the impact upon the siope and wetland/stream areas. The top of slope will be <br /> fenced except for those areas necessary for the buildings footprint and the <br /> wetland/stream area left in its present state and placed witl�in a protective <br /> covenant area. <br /> 2. The proposed development does not pose a threat to the public health, satety and <br /> welfare on or off of the subject lot. If the recommendations of the geotechnical <br /> study arE followed, the development is not anticipated to pose a threat to the <br /> public. <br /> 3. Any alterations permitted to the requirement of this Ordinance shall be the <br /> minimum necessary to allow for reasonable use of the property. The proposed <br /> residence is typical in size to other residences in the area. The applicant proposes <br /> to place the residence within the 25 foot buffer from the top of bank and along <br /> portions of the steep slope areas and reduce the setback from the front property <br /> line to only 6 feet. This will provide a reasonable building footprint for the subject <br /> property. <br /> 4. 1 iie inability of the appficant to derive reasonable economic use o(the property is <br /> not the result of actions by the applicant in subdividing the property or adjusting a <br /> boundar�line thereby creating the undevelopable condition after the effective date <br /> of this G ?ce. The subject property was created pricr to the effective date of <br /> this Ordinance and is a legally created lot. <br /> 2/. <br /> ! <br />
