� <br /> ��. <br /> NOT6CE O� CITY ACTION <br /> PLANNING DIRGCTOR DETERMINATION ���` <br /> II.0 #1-95 <br /> Dear Citizen: <br /> The Ciry of Everett Zoning Code requires you to be notified as an owner of property <br /> within 300 feet of the southeast corner of Terrace and 44th Street of the following action: <br /> The City of Everett Pl�nning Director grants �pproval of� request by Cornerstone <br /> Prosthetics to reduce the required 50 foot wetland b4ffer �ti�idth to 25 feet for a <br /> Category III wetland lacated primarily on the unimproved portion of Terrace Drive <br /> south of 4.tth Street with the following conditions: <br /> 1. Enhance the remaining 25 feet of wedand buffer as proposed in the WeNand Study <br /> Conceptual Mitigation Report prepared by Soil Water Nor.hwest dated <br /> December 29, 1994. The wetland buffer enhancement must be completed prior to <br /> issuance of building permits or a bond worth 300% of remaining improvements <br /> must be submitted to the Planning Department. <br /> 2• Provide a permanent fence a minimum of 42" high alon� the eastem boundary of <br /> the buffer from the south property line of the site to the south end of the cul-de-sac <br /> of Terrace Drive. Solid board, post and rail, chain link, picket fence or other type <br /> of fence that is acceptable to the Plannin�; Department must be used. The fence <br /> must be marked with an Environmentally Sensitive Area sign available from the <br /> Plannin�Department. <br /> " 3� Provide the City of Everett Planning Department a two year assurance device <br /> worth 10% of the cost of planting the buffer prior to issuance of final certificate of <br /> occupancy. <br /> 4. Provide a recorded Environmentally Sensitive Area Protective Covenant <br /> protecting the wetland. <br /> Subsection 37.100.D of the City of Everett Zoning Code gives the Planning Director the <br /> authority to reduce the standard wetland buffer width only when there has been substantial <br /> legal alteration of the wetland and/or its buffer and the remaining buffer is enhanced <br /> sufficiently to improve the functional values of the buffer and/or the wedand. <br /> The Planning Director approved the reduced wetland buffer based upon the following: <br /> 1.
