BOARD Or ADJUSTPfENT <br /> iINDINGS, CONCLUSIONS AND ORDER <br /> (VARIANCE �126-84) <br /> Based upon the written request for a variance from the City's zoning <br /> code, specifically 19.42.040, made by Jule VanDerMeersche at 2113 - 44th S.E. , <br /> hereinafter referted to as "Applicant," the Board of An�ustment, followin� a <br /> public hearing on said application held on October 1, 1984, and further havin� <br /> reviewed all [estimony, makes tlie following Findings, Conclusions, Order: <br /> 0 <br /> � <br /> � <br /> n <br /> FINDINGS AND CONCLUSIONS: m <br /> 1. That there tave been exceptiunal or extraordinary circumstances or � T <br /> conditions applying to the subject property or us to the intended iise �. -i <br /> thereof that do not apply generally to other proparties in the same o m <br /> vicinity or zone. m o <br /> n <br /> a. Finding: The applicant owns a parcel of property at 2113 - o m <br /> 44th S.E. . The properCy is a corner lot 50' x 120'. A single = � <br /> family residence was moved on the site seven (7) feet from the �' <br /> property line adjacent to 44th Street. The i�ouse sits on blocks � � <br /> now. The applicant has had a difficult time making the hor�e � _ <br /> mover place it in its appropriate location. � �, <br /> � <br /> � <br /> b. Conclusion: The extraordinary circumstances are related to the �y <br /> fact tha[ the moving contractor thought the setback was five (5) � r; <br /> feet. The applicant has tried to get the contractor to move the m .- <br /> house to its appropriate location with no luck. oo � <br /> c� m <br /> 2. That such variance is necessary for the preservation and enjoyment of a m � <br /> substant3al property right of the appellant possessed by the owners of z c� <br /> other properties in the same vicinity or zone. �' n <br /> � <br /> a. Finding: The applicant's property is located in an R-2 zone, .� <br /> curner lot, adjacent to 4th and 44th which are 80' &.O.W. z <br /> b. Conclusion: This variance would not effect the pubiic street. _ <br /> v� <br /> 3. That the authorization of such variance will not be materially z <br /> detrimental to the public welfare or injurious to property in the .-�� <br /> vicinity or zone in which the property is located. c=� <br /> r�, <br /> a. Finding: Fourth and 44th Street are 80' public right-of-way. <br /> The variance is adjacent to 44th. <br /> b.
