BOARD OF ADJUSTMENT <br /> FINDINGS, CONCLUSIONS AND ORDER <br /> (VARIANCE If26-84) <br /> Based upon the written request for a variance from the City's zoning <br /> code, apecifically 19.42.040, made by Jule VanDerMeersche at 2113 - 44th S.E. , <br /> hereinafter referred to as "Appl3cant," the Board of Adjustment; following a <br /> public hearing on said application held on October 1, 1984, and further having <br /> reviewed all testimony, makes the following F'ndings, Conclusions, and Order: <br /> �INDINGS AND CONCLUSIONS: <br /> 1. That there have beea exceptional or extraordinary circumstances or ', <br /> conditions applying to the sub3ect property or as to the intended use ! <br /> thereof that do not apply generally to o[her properkt�s in the same <br /> vicinity or zone. <br /> a. Finding: The appiicant owns a parcel of property at 7.113 - I <br /> 44th S.E.. The property is a corner lot 50' x 120'. A single ' i <br /> family residence was moved on the site seven (7) fee[ from the <br /> property line adjacent to 44th Stree�. The house sits on blocks <br /> now. The zpplicant has had a difficult time making the home <br /> mover place it in its appropriate location. <br /> i <br /> b. Conclusion: The extraordinary circumstances are related to the , � <br /> fact that the moving contractor tiiought the setback was five (�) <br /> feet. The applicant has tried to get the contractor to move the ' <br /> house to its appropriate location coith no luck. <br /> 2. That such variance is necessar�• for the preservation a�d enjoyment of n <br /> �ubstantial property right of Lhe appellant possessed by the owners �f <br /> other properties in the same vicinity o� zone. <br /> a. [inding: The applicant's property is located in an R-2 zone, <br /> corner lot, ad,jacent to 4th and 44th which are 80' R.O.W. <br /> b. Conclusion: This variance would not effect the public street. <br /> 3. That the authorization of such variance will not be materially <br /> detrimental to the public welfare or in�urious to property in the <br /> vicinity or zone in which the property is located. <br /> a. Finding: Fourth and 44th Street are 80' public right-of-way. <br /> The variance is adjacent to 44th. <br /> b. Conclusion: Granting the variance would havc no adverse effect <br /> on property in ttie area. <br /> I <br /> -1- <br />
