Finding: The applicant owns a parcel of property at 2113 - <br /> 44th S.E. . The property is a corner lot 50' x 120'. A single <br /> family residence was moved on the site seven (7) feet from the <br /> property line adjacent to 44th Street. The house sAts on blocks <br /> now. The applicant has had a difficult time mal:ing the home <br /> mover place it in its appropriate location. <br /> b. Conclusion: The extraordinar� circumstances are related to tl�:e <br /> fact tha: the moving contractot thought the setback was five (Sj <br /> feet. Ti�e applicant has tried to get the contractor to move the <br /> house to its approoriste locativa with no luck. <br /> 2. That such variance is necessary for the preservation and enjoyment of o <br /> substantial property right of the appellant possessed by the owners of <br /> other propertiec in the same vicinity or zone. r` <br /> � <br /> a. Finding: The applicant's property is located in an R-2 zone, <br /> cor.ner lot, adjacent to 4th and 44th which are 80' R.O.W. <br /> b. Conclusion: This variance would not effect the public street. �'� <br /> 3. ThaL- the authorization of such variance wiil net be materially <br /> detrimantaJ to the public welfare or injurious to property in the ; <br /> vicinity c: zone in which the property is located.
