Enhance the remaining 1?.5 fcet of Uuffer as proposed in the planting plan as <br /> modified by the City of Everett's biologist. <br /> 2. Provide a recorded Environmentaliy Sensitive Area Protective Covena��t <br /> protecting the buffer. <br /> Subsection 37.100.D of the City of Everett Zoning Code gives the Planning Director <br /> the authority to reduce the 25 foot buffer from the top of slope by up tu 50% when <br /> there has been substantial legal alteration of the buffer and the remaining buffer is <br /> enhanced sufficiently to improve the functional values of the buffer. The slope leads <br /> down to a wetland. <br /> The Planning Director approved the reduced buffer based upon the following: <br /> 1. The buffer had been previously altered prior to 1990 except for two large trees <br /> located near the top of slope. The buffer consisted of some Himalayan <br /> blackberry. <br /> 2. The enliancement plan will improve the functional values of die buffer. The <br /> proposai includes removing noanative, invasive plants and revegetating the <br /> remaining buffer with native vegetation. <br /> The Planning Director's determination may be appealed. Any such appeal must be <br /> filed within fourteen calendar days of the date specified below. Appeal forms are <br /> available from the Planning Department and must be submitted along with the required <br /> filin� fee.
