�" <br />WITNESSETH <br />� <br />WHEREAS, the undersigned Grantor(s)/Covenantor(s) is/are the <br />owner(s) of. or has (have) a substantial interest in the real. <br />property legally described above ("Property"); and <br />WHEREAS, O�:mer(s) applied to the City of Everett ior permission <br />to construct an accessory buildinq that idould be accessory to <br />single family use; and <br />WHEREAS, the Grantee/Covenantee, the City of L•'verett, ("City") <br />has a substantia� interest in the safe and effective use of lands <br />within its b�rders and in the health, safety and welfare of its <br />citizens; and <br />'r�THEREAS, the Hearing G::aminer has the authority to all.ow detached <br />accessory buildings to exceed fifteen feet in height, or to <br />exceed one thousand square feet subject to the provisions of EMC <br />19.7.020(K); and <br />WHEREAS, pursuar.t to EMC 19.7.020(K), the applicant made <br />application to the City seekinq the construction of a detached <br />accessory bui].ding to a single family residence that would ex�eed <br />fifteen feet in heighL or one thousand square feet; and <br />WHEREAS, the City of Everett Hearing Examiner has approved said <br />application subject to the applicant complying �.aith all <br />r.onditicns of approval an�l rec�rding a covenant acceptable to the <br />City Attorney's Of.fie�, per the provisions of EhiC 19.1.020(K)(5); <br />and <br />WHEREAS, i�ei'ore the r,ity �aill issue at;y permit or a�proval for <br />the construction oi a detached accessory building to a singie <br />family residecice that ���ould exceed rifteen feet in h�ight or <br />exceed one thousand feet, this Covenant must be signed, <br />acknowledged and recorded in the records of Snohomish County as a <br />restrictive covenant, restricti.ng use by placing conditions on <br />the permission to construct said detached 'accessory building; and <br />WHEREAS, this Covenant concerns the Grantor/Covenantor's use, <br />occupation, enjo,�ment, or development of the Property and <br />benefits the City as Grantee/Covenantee.
