Puecic yras
October 14, 1993
Mr. Tom Jones
5017 23rd Avenue W
Everett, Washington 98203
SUBIECT: Easement - Lot 3
Plat of Seabrooke Highlands
Dear Mr. Jones:
It has come to our attention that there is a discrapancy between the as-built
drawings and the actual field conditions regarding the locanon of the watermain within
the easement on lot 3 of the p]at of Seabrooke Highlands.
The as-built drawings (see attached) indicate a 20' easement parallel to the
Northwest property line of lot 3, with the watermain inset 5' from the edge of the
easement (15' from the property line). However, city crews, in the course of
performing a uti]ity locate, have determined that the actual location of the watermain is
as little as 1' from the inward edge of the easement. This defect is unacceptable to the
city and must be corrected by relocating the watermain within the existing easement to
provide a minimum 5' clearance to the edge of the easement.
The city is holding a$33,000 Warranty Bond (copy enclosed) for the public
improvements in this plat which covers correcton of deficiencies. Please take action to
correct this matter as soon as possible. The applicant for a buildirg permit on lot 3 has
been notified of the situation and it is our understanding that construction on the lot will
remain on hold until there ia a resolution to the problem.
Please contact Paul McKee at (206)259-8810 with any questions.
Sincerely,
rr n ord
Assstant Public Works Director
cc: Tom Coleman
Nicholas Schmitz
;pM:ebamt.Joc
Enclosure

CITY OF EVERETT• 3200 Cedar Street • Everett, WA 98201 •(206) 259-8800 • Fax (206) 259-8882
