crrY or r•:vr�i�;�r�c <br />city fiall <br />L'verett, IV��shington <br />Vn2IAP1CL•' PROCPDURG <br />The City of Everett Board oL Adjustment is authorized by law to conduct <br />hearings and make fi.ndings and determi.nat-.ions therefrom on applications <br />for variances from the terms of the 'Louing Code. In graating such <br />variances, the Goard is required to ccnsider �ach of. the follor�ing <br />determinants: <br />(1) That because of special circumstances applicabie to <br />subject property, including size, shape, topography, <br />location, or surroundings, the strict application to <br />the Zoninq Code is fcund to deprive property of riqh+a <br />and privileges enjoyed by other properties in L-h�� <br />vicinity under identical zone class�fication. <br />(2) That the granting cf the variance will not be materially <br />detrimental to tlie public o;elfare or injurious to the <br />prooerty or i.mprovements in th� vicinii:y of a zone in <br />which subject property is located, <br />(3) That the denial of such variance reyuest would continue <br />or result in an unnecessary hardship to the oroperty <br />owner, thc cause of. whict� �vas bcyond hia control. <br />(9) That any var.iance granted sha].1 be subject to such <br />conditions as will assure that the adjustment therery <br />authorized shall not constitutc a grant of special <br />privileges inconsistent cviL•]1 tlie limitations upon other <br />properties in the vicinity and zone in which the subject. <br />property is situated. <br />The action by the IIoard of Adjustment on appli.cations for a variance is <br />final and conclusive, unless the ori9inal a�alicant or an adverse party <br />files an appeal to the Superior Court for a S4rit of Certiorari, a Writ <br />of Prohibitzon, or a Writ of :�tandamus.
