Terrio hereinaf[er <br />referred to as "Owner," owns certain property witliin thc City ot C•verett legally <br />described as follows: <br />See Exhibit "A" attached. <br />WHEREAS, Owner has applied tor a permit frorn the City of Everett which <br />under Ordinance 555-78 and subsequent amendments thereto rcquire certain improve- <br />ments to be made to public rights o[ way as a condition to issuance o( certain City <br />permits; said Ordinances allow that the City [ngineer may accept a covenant consenting <br />to the formation of a local impro•:ement district in lieu o[ having Owner construct <br />and install the required public improveme•its. <br />WHEREAS, Owner's property and the adjacent public rights ot way have <br />been determined to reyuire a covenant consenting to the formation of a local improve- <br />ment district ratlier tlian having Owner make specitic irnprovements. <br />NOW, THLREFOR[, in consideration of issuance ot applicable City perrnit(s) <br />pursuant to Ordinance No. 555-78 and subsequent amendments thereto and in lieu <br />oi certain public right ot way impruvements Ownr_r consents to the formation of <br />a local improvement district hereatter [ormed by thc City or its successors or <br />other property owners for tl�e public improvement o[: <br />Construction of a sewer main on Slst Srreet S.W. <br />or a portion thereot including street impruvernents defined in Ordinance Nos. 555- <br />78 and subsequent amendments to includc: <br />The installation oi all public iacilities required to improve <br />the street to City design standa.rdsincluding gradin�, drainage, <br />pavement, curb/gutter, sidewaP<, street lights, traflic signals <br />and other necessary appurtenances.
