BOARD OF ADJUSTMENT <br />FINDINGS, CONCLU510NS AND ORDER <br />VAF.IANCE #02-001 <br />Based upon the testimony presented at the hearing and the written request for a <br />variance from the City's Zoning Code by: <br />Applicant: <br />Don Schwab <br />5402 S. 2"' Avenue <br />Everett, WA 98203 <br />hereinafter retarred to as "Applicant," for a variance from Section 39.150.C;.5 of <br />the Zoning Code wfiich restricts the height of retaining walls within a setback area <br />to a maximum of 36 inches. The applicant is seeking a variance to keep hnro <br />retaining walis each of which encroach into the front 20 foot setback, and exceed <br />36 inches in height. The walls were erected as part of a building permit for the <br />construction of a new single family residence on site.
