As was explained to you in a letter by Dennis Derickson, the
City's Plann'ug nirector, a schwl activity is an expansion of your current use and
is subject t the City regulations which reyuire you to obtain a Special Property
Use Permit. I will assume tliat you recived a copy of the City Coe section which
applles to your proposed uve.
One of the puroses of requirin your poposed school to obtain a Speciel Property
Use Permit i:; to insure that the facility meets fire and safety codes and is
compatible with the surrounding residential neighboriiood. Compliance with these
requirements is not only to the City's benefit, but also to the benefit of the church
and the children who attend your school.
Even though you may view the school activity as an extension of your regulnr
church curriculun, the City nevertheless has the responsibility to insist that you
obtain a Speciel Yroperty Use Permit. Unfortunately, the City does not tiave the
latitude to meke a speciel exception in the case of your proposed school. y
1 have been informed that you intend to open the sehool and begin elasses this -+ ;
week. While the Cit cannot condone the opening of the school without the proper o
permit, it is willing to consider giving you speciul consideration in keeping the
sehool open during the pendency of the special prnperty use permit proceedings if
you would reciprocete by immedintely cantacting the City to meke arrangements
to aequire the necesary permit. I would ask that you contact Gerry Ervine at
259-8731. However, if Mr. Ervine hrs not been contacted by Monday,
September 14, 1981, this office will have no alternative but to eonsider what legal Q =
recourse would be required to insure that the City Code is complied with.
 ,
T urge you to contact the City as soon as possible to nvoid placing your chool in
jeopardy of being closed down. If you or your uttorney have any questions you o
would like to address to me, please do not hesitnte to contact me. c

c:
 :
 ;

y ::
;
