property, singly and together demonstrate that the proposed development of the <br />property will probably generate signlficlant adverse environmental Impacts. <br />The DNS does not require the developer to conduct a geotechnlcal study, <br />although It does "encourage" it. This study should be made a requirement before a <br />DNS or DS is issued. The study should not only examine the sub.lect property but <br />adjaclent and nearby property as well. The hillside in general is a seepage area. <br />One seep has very recently been found to emerge from under the nearest dwelling and <br />courses north and west onto the applicant's property. Some Indication exists that a <br />property within 100 to 150 yards to the south has experienced landslide activlty. <br />Other Indication exists of subsidence on adjaclent or nearby property. These <br />Indications should be verified. Additional examination of seeps and possible <br />landslide and subsidence areas should be made before a determination is made. <br />Further, since the property contains organic and hydrlc soils, a strong likelihood <br />exists that much such soil must be removed, replaced with compactable material and <br />then mechanically compacted. The possible effects of the vibrations from mechanical <br />compacting cn the neighboring properties must be addressed by a geotechnicai study. <br />3. Effec on Powder Mill Gulch Stream <br />The DNS fails to deal with Power Mill Gulch as a fishery resource. The runoff <br />associated with tree cutting, vegetation removal, land clearing, uncompactable soil <br />removal, compactable soil placement and compacting, filling and other pre <br />construction and construction activities are not adequately addressed and constitute <br />a probable significant adverse environmental Impact on the creek and any existing or <br />potential fishery. The collection and disposal of storm water runoff during or after <br />construction is not dealt with. Tre Boeing Company, Trourt Unlimited, The Pilchuck <br />Audubon Society and Streamkeepers are committed to enhancing and restoring Powder <br />Mill Gulch Creek fishery. The DNS dons not deal In any way with the Impacts of the <br />changes the development would make on Powder Mill Gulch Creek. There is a stong <br />likelihood that the development will adversely !mpact the fishery potential of the <br />creek. The effects of this proposal on the creek must be made the subject of a <br />fisheries study by a competent wetlands and fisheries biologist. <br />4. Conclusion <br />The proposal will involve substantial disturbance to vegetalon and soils <br />because much of the surface soils are not compatible with construction and will have <br />to be removed. This violated EMC 20.04.060 A. 1. a. <br />The Proposal will require changes to the topographical nature of the <br />existing property in violation of EMC 20.04.060 A.I. b. <br />The proposal will allow development on steep slopes where there may be <br />Imminent danger of landslides in violation of EMC 20.04.060 A 1 c. <br />The proposal will involve substantial diversion and create altered methods <br />of runoff In violation of EM; 20.04.060 A. 3. a. <br />The proposal shows no minimization of degredatalon of water sedimentation <br />or of enhancement of the suitability of water for fishing and thus violates EMC <br />20.04.060 a. 3. b. <br />The proposal Involves substantial adverse effects on and alteration of <br />ground water location and flow patterns and thus violates EMC 20.04.,060 A 3 c. <br />The proposal Involves probable significant adverse environmental Impacts <br />which have not be dealt with through the mitigation measures required and therefore <br />an Environmental Empact Study should be required. <br />We reserve the right to amend this letter of appeal. <br />3 <br />
