3. Effect on Powder Mill Gulch Stream <br />The approval to the short subdivision fails to deal with Power <br />Mill Gulch as a fishery resource. The runoff associated with tree <br />cutting, vegetation removal, land clearing, uncompactable soil <br />removal, compactible soil placement and compacting, filling and other <br />pre construction and construction activities are not adequately <br />addressed and constitute a probable significant adverse environmental <br />Impact on the creek and any existing or potential fishery, violating <br />both the environmental policies and Sub.Ord. Section 4.D.3,e. The <br />collection and disposal of storm water runoff during or after <br />construction is not dealt with. The Boeing Company, :'rout Unlimited, <br />The Pilchuck Audubon Society and Stream Keepers are committed to <br />enhancing and restoring Powder Mill Gulch Creek fishery. The approval <br />does not deal In any way with the Impacts of the changes the <br />development would make on Powder Mill Gulch Creek. There is a stong <br />likelihood that the development will adversely Impact the fishery <br />eotential of the creeK. The effects of this proposal on the creek <br />must be made the subject of a fisheries study by a competent wetlands <br />and fisheries biologist. <br />4. Conclusion <br />The proposal will Involve substantial disturbance to <br />vegetalon and soils because much of the surface soils are not <br />compatable with construction and will have to be removed. This <br />violates Sub.Ord. Section 5, C. 1. (EMC 18.24.040) and EMC 20.04.060 <br />A. 1. a. <br />The Proposal will require changes to the topographical <br />nature of the existing property In violation of Sub.Ord. Sections 5, <br />C. 1, 3, 9.b, 14.A, 9.b, (EMC 18.24.040, 060, 110 A,.120 b., .170 ) <br />EMC 16.56.120 and EMC 20.04.060. <br />The proposal will allow development rn steep slopes where <br />there may be imminent danger of landslides In violation of EMC <br />20,04.060 A 1 c. <br />The proposal will involve substantial diversion and create <br />altered methods of runoff in violation of Sub. Ord. Section 5.C.9.b. <br />(EMC 18.24.120 B) and EMC 20.04.060 A. 3. a. <br />The proposal shows no minimization of degredatalon of water <br />sedimentation or of enhancement of the suitability of water for <br />fishing and thus violates EMC 20.04.060 a. 3. b. <br />The proposal involves substantial adverse effects on and <br />alteration of ground water location and flow patterns and thus <br />violates Sub.Orc. Section 5. C. 1, 9.b (EMC 18.24.040,.120 B) and EMC <br />20.04.,060 A 3 c. <br />The proposal Involves multiple violations of the Subdivision <br />Ordinance (EMC 18.24) and probable significant adverse environmental <br />Impacts which have not be dealt with through the mitigation measures <br />required and therefore the approval should be reversed and the plat <br />approval denied. <br />We reserve the right to amend this letter of appeal. <br />5 <br />
