BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE NO. 17-89 <br />Based upon the written request for a variance from the City's <br />zoning code by: <br />Baxter Fisher, Inc. <br />2600 34th Ave. W. <br />Seattle, WA 98199 <br />hereinafter referred to as "Applicant," for a variance <br />From E.M.C. 19.19.12.060, (B), Height Limitations, to allow con- <br />struction of a single family residence that will meet the 28 <br />foot height limit as measured from the average elevation of the <br />existing topography, but because of the extreme change in grade <br />would exceed the maximum 35 feet in height as measured from the <br />lowest point on the building footprint and from E.M.C. <br />19.12.060, to allow a covered walkway that would be twenty feet <br />above the average elevation at the foot of the structure instead <br />of the fifteen feet allowed by code. <br />On the following described p=•operty: Lot 6, Block 3, Shore <br />Acres Addition EXCEPT the east 20 feet thereof and along with <br />easements for ingress and egress. <br />Commonly known as: 5048 33rd Ave. W. <br />The Board of Adjustment, following a public hearing on said ap- <br />plication held in August 7, 1989 and further having reviewed all <br />testimony, makes the following Findings, Conclusions and Order: <br />That there have been exceptional or extraordinary circumstances <br />or conditions applying to the subject property or as to the in- <br />tended use thereof that do not apply generally to other proper- <br />ties in the same vicinity or zone. <br />a. Finding: The Applicant is proposing to construct a <br />single family structure on a 125 foot by 121 foot view <br />lot that has some extreme changes in topography within <br />the footprint of the building and the accessory struc- <br />tures. The highest point of elevation is 221 feet and <br />the low point is 176 feet which is a difference of 45 <br />feet. There will be a minimal amount of grading done as <br />the house will be stepped into the hillside and by so <br />doing will be able to meet the 28 foot height limitation <br />for the house, but because of the extreme changes in to- <br />pography, the building will exceed the 35 foot total <br />height allowed by code from the lowest point of the <br />building footprint. <br />In order to minimize the impact on the view of the home <br />to the east of the subject property, the Applicant has <br />designed the project so the garage will be constructed <br />on the northeast corner of the lot across the swale from <br />the home thus leaving a view corridor for the home to <br />the east. The applicant is proposing to provide a cov- <br />ered walkway over the swale for access between the house <br />and the garage. Because of the extreme change in topog- <br />raphy, the covered walkway will exceed the fifteen foot <br />height allowed by code for accessory structures by five <br />feet. <br />
