a. Finding: The Comprehensive Plan designation for this <br />site is single family residential and the proposed use <br />is single family residential. <br />b. Conclusion: Granting this variance will not adversely <br />affect the Comprehensive Plan. <br />NOW, THEREFORE, the Board of Adjustment of the City of Everett <br />does hereby order that the variance be GRANTED to allow con- <br />struction of a single family residence that will meet the 28 <br />foot height limit as measured from the average elevation of the <br />existing topography, but because of the extreme change in grade <br />would exceed the maximum 35 feet in height as measured from the <br />lowest point on the building footprint and from E.M.C. <br />19.12.060, to allow a covered walkway that would be twenty feet <br />in height instead of the fifteen feet in height above the aver- <br />age elevation at the foot of the structure allowed by code. <br />and further require the applicant to meet the following condi- <br />tions. <br />1. The project shall be developed per the site plan submitted <br />with this application (Exhibit 2). <br />2. The Applicant shall obtain all necessary building and public <br />works permits. <br />The action of the Board of Adjustment in GRANTING a variance <br />shall be final and conclusive, unless within fifteen (15) days <br />from the date of issuance and signing of this order by the <br />Chairman of the Board, an aggrieved person or persons obtains a <br />writ of certiorari from the Superior Court of Washington for <br />Snohomish County for the purpose of review of the action taken. <br />DATED this 7th day of August, 1989. <br />/�2.� <br />Chairman, Board of Adjustment <br />Notes to Applicant: <br />1. If a building permit is not obtained within one year from <br />the above date, the Board's decision shall cease to be effec- <br />tive.
