,/ <br />FINDINGS AND DECISION <br />OF THE HEARING EXAMINER-OF THE <br />CiTY OF EVERF_TT <br />IN THE MATrER OF TH� APPEA� <br />OF HENRY & CONSTANCE CHAPMAN APNEAL #04-001 <br />DECISION: The City of Everett Pl�nning DepartmenPs denial of a <br />non-conforming lot certification is overturned, and ihe <br />property at 5102 — 33`d Avenue West, Everett, <br />Washington, is permiited to be developed and <br />expanded as a non-conforming lot. <br />INTRODUCTION <br />On November 15, 2004, the City of Everett Planning Department issued a written <br />decision denying an application by Henry and Constance Chapman (Appellants) for a <br />non-conforming lot certification of the property at 5102 — 33`d Aventie West, Everett, <br />Washington (subject property). On November 29, 2004, the Appellants filed an appeal <br />of ihis determination. <br />A hearing on the appeal was held before the Hearing Examiner of the City of Everett on <br />January 20, 2005.
