BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE NO. 1-88 <br />Based upon the written request for a variance from the City's zoning code by: <br />William L. O'Brien <br />5037 33rd Ave. W. <br />Everett, WA 98203 <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />19.12.050(A), Front Yards to allow: a ten foot front yard setback from the <br />east property line <br />on the following described property: <br />A portion of Lots 1 and 2, Block 3, Shore Acres Addition to Everett, <br />as recorded in Volume 8 of Plats, page 32, Records of Snohomish <br />County, Washington, more particularly described as follows: <br />Beginning at the southeast corner of said Lot 1, thence N 0019'28" <br />W along the east line of said Lot 1 for 124.68 feet to a point 15.0 <br />feet south of the northeast corner thereof, thence west for 85.0 <br />feet; thence S 39029'19" W for 53.89 feet; thence south for 30.0 <br />feet; thence west for 30.0 feet; thence south for 55.0 feet to a <br />point on the south line of said Lot 2, 133.41 feet east of the <br />southwest corner thereof; thence N 89016'05" E for 150.0 feet to <br />the point of beginning. <br />Together with a one -quarter (1/4) interest in the private road and an <br />easement over a portion of vacated Puget Avenue as described above. <br />commonly known as: 50XX 33rd Ave. W. <br />The Board of Adjustment, following a public hearing on said application held <br />On February 1, 1988, and further having reviewed all testimony, makes <br />the following Findings, Conclusions and Order: <br />VARIANCE CRITERIA: <br />Findings and Conclusions: <br />Criterion No. 1: That there have been exceptional or extraordinary <br />circumstances or conditions applying to the subject property or as to the <br />intended use thereof that do not apply generally to other properties in the <br />same vicinity or zone. <br />a. Finding #1: This lot fronts to the east towards the unimproved <br />right-of-way of 33rd Avenue West. This right-of-way is only 30 feet <br />wide and dead -ends at the south line of the subject property. There <br />is a large vacant parcel to the east of this lot and if and when it <br />develops, additional right-of-way may be obtained and 33rd Avenue <br />West may be improved. <br />Access to the subject lot is provided via a private road on the north <br />off 33rd Avenue West. The applicant wishes to orient the house to <br />the north towards the private road since it is a view lot and the <br />view is to the north and west. In addition, moving the house further <br />to the east than a 40 foot front setback allows would enhance the <br />view from the home since it would be the highest point of the lot. <br />
