,-k NARRATIVE STATEMENT <br />O'BRIEN VARIANCE <br />REQUESTED VARIANCE: <br />We are requesting a variance from the front yard set backs <br />required in a RS zone due to the view orientation of the lot. <br />Although the front of the lot is considered to be fronting <br />on 33rd Ave W, an unimproved, non -conforming city street, the <br />view orientation of the lot is to the north and west which <br />fronts on a private road developed to serve four lots <br />abutting it. We originally designed the private access road <br />so the ingress and egress to these lots could come from 33rd <br />Ave W.. Since 33rd Ave W., at the lot is an unimproved city <br />street which dead ends at the south boundary line of this <br />lot, and does not conform in size due to it's 30 foot width, <br />we have always felt that that would be considered the side <br />yard of the lot. We are asking therefore, that the normal <br />side yard set backs in an RS zone apply along the east line <br />of the lot. This then means that we are asking to change the <br />setback from 55 feet from the middle of the right of way of <br />33rd to a setback seven and one-half feet from the east line <br />of the lot. <br />A. The exceptional and extraordinary circumstance in this <br />case are that the lot orients itself to a front yard <br />to the north rather than to the east for two reasons: <br />1) that the view orientation is to the north and to <br />the west, and <br />2) that the access to the lot for ingress and egress <br />is from the private road rather than from 53rd. <br />The street, 33rd Ave. W., is presently unimproved and <br />there are no plans to develope it in the future as a <br />through street. The topography of the lot would also <br />indicates placement of the house closer to the east <br />line of the lot because that is the highest level of <br />the lot. No other exceptions are being requested. <br />B. This variance is needed to enjoy maximum amount of <br />view from this lot. The neighborhood is an area of <br />view homes, all of which are oriented to the view. <br />C. The placement of the house with this setback change <br />will not adversely affect the properties behind, and <br />in fact, may allow additional view for them that they <br />would not have otherwise, should the house be placed <br />further to the west. The house directly behind this <br />lot currently enjoys a view to the west and to the <br />north. With the placement of the house as we would <br />like, that home would still enjoy a west and <br />northwesterly view. <br />D. The granting of this variance would have no affect <br />on the comprehensive general plan. <br />We thank the City for their help in advising us how to <br />prepare this variance application and we thank the Board of <br />Adjustment for their time in considering this application. <br />We would also like to point out that we are not asking for <br />any other exceptions to the building code setback <br />requirements or height requirements. <br />
