The criteria <br />(as listed m Conclusion 2) have been satisfcd tc> allow the accessory <br />building to exceed 15 feet in heiyht. jfindings 7 through 11) The <br />Applicant has adequately proven that the 20.5 toot height of the <br />detached accessory building will create greater compatibility than the <br />height es recommended by the City. <br />DECISION <br />Basea upon the preceding Findings of Facts and Conclusions, testimony and <br />evidence submitted at the public hearing, and upon the impression of the <br />Hearing Examiner at a site view, it is hereby ordered that the Applicant is <br />granted exceptions to the standards of tMC 19.7.020.B and EMC 19.7.020.H <br />and is allowed to construct a detached accessory building that will be a <br />mzxirnum of 20.5 feet high with an area coverage of 1,046 squarE feet. This <br />detached accsssory building is allowed subject to the following conditions: <br />A covenant acceptable to the City Atto;ney's Office shall be recorded on <br />the title !o the proparty stating that the property owner acknowledges the <br />req�iirements of this section, and that the use of any accessory building <br />is limited to accessory activities permitted in the R-1, Single-Family Zone <br />in which the property is I�cated, and that the accessory building shall not <br />be converted to living area o�� used for any purposes which are not in full <br />compliance ��rith Zoning and Building Code requirements. <br />2. The Applicant shali obtain all required Building Permits from the City of <br />Everett's Building Department. Compliance with the State Building Code <br />is required. <br />3. The ma:;imum height of the detached accessory building shall not <br />exceed 20.5 feet in height above the base elev� `.ion. <br />4. The garage's siding and roofing material must be similar to the existing <br />dwelling. <br />5. The detached accessory building must have a pitched roof. <br />6.
