However, ehould any Owner desire to make any changes during consiruction in the approved site plan or terms of this Agreement, apecifically regarding landscaping and eignage, said Owner ahall � , bring this to the immediate attention of the City's Planning Director or City Engineer. If, after reviewing a detailed site Iplan, the Planning Director or City Engineer determine that the change proposed is not subetantial, (meaning a change of 10� or leas), the Planning Director or City Engineer may author7ze the change. However, if in the opinion of the Planning Director or City Engineer the requested change is a aubatantial change, the Octner chall be required to go to the Hearing Examiner to seek � authorization for the propoaed change. The Planning Director's ior City Engineer's ruling may be appealed to the Hearing Examiner. In any event, any[ime a change resulte in a substantial change to the terme or requirements of thia Agreement, this Agreement muet be amended by vritten amendments hereto duly executed by the Owner an�l the City's Mayor.
