EasEri�Nz• <br /> This easement is granted subject to and conditioned upon the following terms, conditions and <br /> covenants: <br /> 1. Grantor shall at alliimes conduct its activities and all other activities cOnducted on <br /> Grantor's property so as not to interfere with, obstruct or endanger the usefulness of any <br /> improvements, or other facilities, now or hereafter maintained upon the easement, or in any <br /> way interfere with, obswct or endanger the Ciry's use of the easement. <br /> 2. Prior to any construction, work or any other activiry by Granror within the easemen[, <br /> notification and plans for the same shall be submitted in writing to the Ciry by Granror and no <br /> such construction, work or activity by Grantor shall be commenced without Ciry's prior <br /> written agreement that the Gran[or's proposed construction, work or activity will not interfere <br /> with the Ciry's easement granted herein; PROVIDED, HOWEVER, any changes or revisions <br /> in the plans shall also be subject to City's prior agreement. The City's revie�v of the Grantor's <br /> plans under this easement shall not be deemed to impose any dury or obligation on the City to <br /> determine the adequacy or suFticiency of Grantor's plans and designs nor whether Grantor's <br /> construction, work or activity is in conformance with other applicable pfans, codes and <br /> regulations. Further, agreement by the Ciry to such construc[ion, work or activiry shall not in <br /> any manner be considered as imposing any obligation, dury or liability upon the City as to [he <br /> safety or propriety of such cons[ruction, work or activity. <br /> 3. Grantor hereby authorizes Ciry to cut, trim and remove any and all brush, trees, <br /> other vegetation or debris upon the easemen[ and the right of access for such purposes. <br /> Gran[ur also authorizes the City to cut, trim and remove any and all brush, trees, other <br /> vegeta[ion and debris on Grantor's properry which, in the Ciry's reasonable judgment, <br /> cons�icutes u hazard [o the easement and the right of access for such purposes. <br /> � <br /> AF20 �o � �J41g0192 <br /> 2/a <br />
