Letter from Debbie Anderson <br /> After due wnsideraCion of the evidence presented by the Applicant; evidence <br /> elicited during the public hearin9; and as the result of the personal <br /> i.nspection • of ihe subject property and surrounding areas by the EVerett <br /> Hearing F�caminer, the following findings of fact and conclusions constitute <br /> the basis of the decision of the E�erett Hearing �caminer. <br /> FIDIDIN(>S �' FACt•' <br /> 1. The Applicant has requested approval of a Shoreline Substantial <br /> Developnent Permit (Permit) for property that is located between 110th <br /> Street S.E. ard State Route 527, west of 23rd Drive S.E. in the City uf <br /> EWerett, Washington. 7t�e Permit is sought foc the developnent of the <br /> property with a complex �nsisting of 224 aparUnent units. (staff <br /> report) <br /> 2. RLW 90.58 sets forth the Shoreline Manayement Act of 1971 for the State <br /> of Washington. R(,W 90.58.140(2) requires that no substantieil <br /> developnent shall be imdertaken on shorelines of the State �f <br /> Washington without a Permit fran the government entity having <br /> administrative jurisdiction. A substantial development is defined as a <br /> developnent where the total fair market value exceeds 51,000.00 or any <br /> developnent which materially interferes with the normal public use af <br /> the water or shorelines of the State. (RCW 90.58.030(3) (E) <br /> 3. 'lYie proposed development of the Applicant is a substantial development <br /> which the total crost of the fair market value will exceed $1,000.00. <br /> �e City of E�erett is justified in requiring the Applicant to obtain a <br /> Shoreline Substantial DeveloPnent Permit. (administrative finding) <br /> 4. 1t�e subject property is zoned B-2(A) Oamiunity Business - Site Plan <br /> Review subject to R-3(A) uses developed to R-3(A) standards. R-3(A) <br /> zoning allows development of multiple family housing through a detailed <br /> site plan review process. 7.t�e Applicant has opted to have a Shoreline <br /> Management Permit Reaiew be the detailed site plan review procesa. <br /> (Ecvine testimony) <br /> 5. Tt�e subject property was recently annexed inCo the City of �erett. <br /> Because the pcoperty is located near a significant body of water, <br /> Silver Iake, it is under the jurisdiction of the Washington State <br /> Shoreline Act of 1972, R�d 98.58 and WAC 173-15. 'fie shoreline <br /> management of the site is controlled by the State approved Local <br /> Shoreline Master Program. However, the City of EVerett has not amended <br /> its Master Pro9ram to include }1�e subject property. As a result, WAC <br /> 173-19-004 authorizes the Cily of EWerett to use the Snohomish County <br /> Mastec Program until the City amends its Master Program to include the <br /> subject property. Accrordingly, the City has used the Snohomish County <br /> Shoreline Master Program to review the Permit requesl. (administcative <br /> finding) <br /> I <br />
