The Applicant has requested approval of a Shoreline Substantial Developnent Permit (Permit) for property that is located between 110th Street S.E. ard State Route 527, west of 23rd Drive S.E. in the City uf EWerett, Washington. 7t�e Permit is sought foc the developnent of the property with a complex �nsisting of 224 aparUnent units. (staff report) 2. RLW 90.58 sets forth the Shoreline Manayement Act of 1971 for the State of Washington. R(,W 90.58.140(2) requires that no substantieil developnent shall be imdertaken on shorelines of the State �f Washington without a Permit fran the government entity having administrative jurisdiction. A substantial development is defined as a developnent where the total fair market value exceeds 51,000.00 or any developnent which materially interferes with the normal public use af the water or shorelines of the State. (RCW 90.58.030(3) (E) 3. 'lYie proposed development of the Applicant is a substantial development which the total crost of the fair market value will exceed $1,000.00. �e City of E�erett is justified in requiring the Applicant to obtain a Shoreline Substantial DeveloPnent Permit. Because the pcoperty is located near a significant body of water, Silver Iake, it is under the jurisdiction of the Washington State Shoreline Act of 1972, R�d 98.58 and WAC 173-15. 'fie shoreline management of the site is controlled by the State approved Local Shoreline Master Program. However, the City of EVerett has not amended its Master Pro9ram to include }1�e subject property. As a result, WAC 173-19-004 authorizes the Cily of EWerett to use the Snohomish County Mastec Program until the City amends its Master Program to include the subject property. Accrordingly, the City has used the Snohomish County Shoreline Master Program to review the Permit requesl. (administcative finding) I
