The subject property <br />is legally described in Exhibit "A" attached hereto and <br />incorporated herein by this reference (the "Property") <br />B. on August 17, 1989, SLAC filed a request for review <br />with the Shoreline hearings Board, appealing the City's issuance <br />of the DNS and the substantial development permit for the <br />Project (the "Appeal"). <br />C. In accordance with the conditions in provisions of this <br />agreement, SLAC, and its officers on behalf of themselves and <br />all members of SLAC, either individua7.ly or through SLAC, have <br />agreed to withdraw the Appeal and all issues raised by SLAC in <br />connection with the Appeal and the Project including, without <br />limitation, the challenge to the issuance of the DNS and <br />substantial development permit. SLAC has agreed to bring no <br />further challenge to the Project and has agreed not to further <br />oppose or impede in any manner the development of the Project, <br />so long as Bay Ridge complies with the terms of this agreement <br />and the City's conditions of approval of the substantial <br />development permit. <br />D.
