<br /> laws of the State of Washington, hereinafter referred to as "City."
<br /> In cansiderati.on of One Dollar ($1.00) and other good and valuable
<br /> cr-nsideration in hand paid, receipt of which is hereby aclmowledged, and
<br />� in consideration of the perfosnance of the covenants, tex�ns and conditions
<br /> herei.nafter set forth, Grantor hereby conveys the following easanent:
<br /> An exclusive perpetual easem.nt across, along, in, upon and
<br /> under Grantor's property described below for the puxpose of
<br /> ccnstructing, reconstructing, operating, maintaining and NO EXCISE T
<br /> repairing: REQUfREC
<br /> Sewps systen ca�lete with pipe, fittings, and appurtenances
<br /> pursuant to Silver Lake L.z.D. No. ��9, APR 1 7 198C
<br /> I,; together with the right of ingress to and egress fran said
<br /> property and across adjacent prooerty of the Grantor and the ��2�;�r wnvGGjE
<br /> right to use adjacent prooerty of the Grantor for the puLvose�'
<br /> i of piling dist and trench stabilizati.on during the constsuct- �
<br />� inq. reconstructing, �a�J, mainta;n;*+;, and rereoairing
<br /> the aforesaid i�rwarpnt or facility; nrovided, however, that
<br />� the piling of dirt shall be limited to an area rwt to exceed
<br /> J 5 feet in width, adjacent to the easanent, ��d for a period
<br /> of t.ime not to exceed 30 days. The City agrees to clean and
<br />' restore the area utilized for storage of dirt.
<br /> The easanent is wer and across a tract of land situated in the County of
<br /> Snohanish, State of Washington, and the easemnt is described as follows:
<br /> 'That portion of Lot 16, Block 1, Silver Lake, according to
<br /> � the Plat recorded in Voliune 9 of Plats, Page �4, as descri�d
<br /> j on Exhibit "A" and "B" attached heseto an3 incorporated by
<br /> reference.
<br /> ' This easa�nt is granted subject to and conclitioned upon the follaaing tesms,
<br /> conditions and covenants:
<br /> 1. Grantor shall at all times conduct its activities and all other
<br /> activities conducted on Grantor's property so as not to interfere with,
<br /> obstruct or endanger the usefulness of any imprave�ents, or othe_ facilities,
<br /> now or hereafter maintained upon the easanent, or in any way interfere �ith,
<br /> obstruct or endanger the City's use of the ease�nt.
<br /> 2. Prior to any construction, work or any other activity by Grantor
<br /> ' on the ease�nt, a notification and plans for the same shall be sulan.ii:ted in
<br /> writing to the City by Grantor and no such construction, work or activity
<br /> shall be camienced without City's prior written agre�lit that the Grantor's
