Their use was initially <br /> determined to fall into the land use category of"preschool"as listed in our zoning code. In <br /> reviewing the code, Review Process III is required for a preschool in the B-1 zone. In discussing <br /> the nature of their business,we Iearned that it wili be contained entirely within an enclosed <br /> building space,with no outdoor playground or activity area. All activities will be held indoors <br /> during their two 2-hour sessions each day. In discussing the reason for classifying preschools as <br /> a Review Process III in the B-1 zone, it was my best recollection and opinion that the reason for <br /> the Review process III is to allow for public notification and comment on preschool facilities that <br /> typically have outdoor play areas. The Engaoing Minds learning center does not have an outdoor <br /> play area. It is not a day care center. The proposed business will have a two-hour learning <br /> session in the morning, 2nd one in the afternoon, each for different s tudents. It functions more <br /> like a Sylvan learning center than the type of preschoot envisioned in the draking of the zoning <br /> code. There is no outdoor play area, no food handling or snack time,as is normally included in a <br /> preschool. Based on our understanding o'the way that this business will operate, I am <br /> comfortable in finding that it is more like a private instruction class than a typical preschool in <br /> which children are present for a longer period of time z• d have periods for outdoor play. I woulc� <br /> put it in the land use classification of"private instruction"which is Review Process I in the B-1 <br /> zune. <br />
