BOX C-3755 <br />S'_ATTLE, WASHINGTON 98124-2255 <br />Regulatory Branch <br />MAR 3 0 1988 <br />Mr. Jim Miller <br />Lovell - Sauerland & Associates, Inc. <br />23106 - 100th West <br />Edmonds, Washington 98020 <br />Dear Mr. Miller: <br />On March 21, 1988, you met with Mr. Richard Berg of this office <br />and provided information concerning the proposed Metco Construction <br />project near Everett, Snohomish County, Washington. The project site is <br />located at 121st Southeast and Bothell Everett Highway. You inquired <br />about permit requirements for placing fill on this site. <br />Based on the information you have provided, we have determined <br />that all of the wetlands at the site are considered wetlands under <br />Department of the Army jurisdiction pursuant to Section 404 of the <br />Clean Water Act. The two wetlands at the south portion of the property <br />are considered isolated wetlands with a combined toal area of <br />approximately 0.3 acres. <br />Department of the Army regulations dated November 13, 1986, <br />authorize certain activities under nationwide permits. Paragraph <br />330.5(a)(26) of these regulations authorizes discharges of dredged or <br />fill material into nontidal rivers, streams, and their lakes and <br />impoundments, including adjacent wetlands, that are located above the <br />headwaters (where the average annual flow is less than 5 cubic feet per <br />second). Similar discharges are also allowed into other nontidal waters <br />of the United States that are not part of a surface tributary system to <br />interstate waters or navigable waters of the United States (i.e., <br />isolated waters). The discharge area must be less than 1 acre. <br />Based on this information, you may place fill material so that <br />less than 1 acre of wetlands is modified. No indivic!ual Department of <br />the Army permit will be required, provided the enclosed nationwide <br />permit conditions are met. <br />
