EASEMGNT <br /> This casement is granted subject to and conditioned upon the following ternis, condi[ions and <br /> covenants: <br /> 1. Grantor shall at all times conduct its activities and ail othcr act�vities conducted on <br /> Grantor's property so as not to interfere with, obstruc[ or endanger the usefulness of any <br /> improvements, or other facilities, now or liereaftcr maintained upon the easement, or in any way <br /> interfere with, obstruct or endanger the City's use of the easement. <br /> 2. Prior to any construction, work or any othcr lctiviry by Grantor within the e�sement, <br /> notification and plans for the same shall be submitted in writing to the City by Grin:or and no <br /> such construction> �vork or activity by Grantor shail be commenced without City's prior �vritten <br />' agreement that the Grantor's proposed construction, work or activity will not interfere with the <br /> City's easement granted herein; PROVIDED. HOWEVER, any changes or revisions in the plans <br /> shall also be subject to City's prior agrcement. The City's review oP[he Grantors plans under tltis <br /> easement shall not be deemed to impose any dury or obligation on the City to determitie the <br /> adequacy or sufficiency oP Grantor's plans and designs nor wltether Grantor's construction, work <br /> or activity is in conformance with other applicable plans, codes and regulations. FuRher, <br /> agreement by the City to such construc[ion, wo�k or activity shall not in any manner be <br /> considered as imposing any obligation, duty or liability upon die City as to the safety or propriety <br /> of such construc!ion, work or activity. <br /> 3. Grantor hereby authorires City to cut, trim and remove any and all brush, trees, other <br /> vegeta[iou or debris upon die easement and the right of access for such purposes. Grantor also <br /> audiorires tlie City to cu[, trim and remove any and all brush, trees, other vegetation and debris <br /> on Grantor's property �vhich, in the City's reasonable judgment, constitutes a hazard to the <br /> easemcnt and die right of aceess for such purposes. <br /> � /�� <br /> � <br />
