<br />2. The proposed rezone bears a substantial relation to the public health, safzty and welfare;
<br />3. The proposed rezone promotes the bzst long term interests of the Everett communitv: and
<br />4. The terms of this resolution aze sufficient to mitigate the impacu of the proposed rezone.
<br />NOW, THEREFORE, BE i� RESOLVED that the City Council of the Cicy of E�•erett
<br />declares its intent to rezone property located at 9707 and 9709 19th Acenue SE, a vicinirv
<br />map of which is attached hezato as E;chibit "A," from R-2(A) (Sinele Family Attached
<br />i�tedium Density) to B-2 (Community Business), pursuant to the provisions of Section
<br />41.160 of Ordinance No. 1671-89, as amended, and the Comicil shall by Ordinance, effzct
<br />such rezone upon being advised that all of the following conditions> stipulations, limitations,
<br />and requirernenu contained in this Resolution have been met:
<br />1. Development of the site shall be in conformance with the conceptual site plan attached
<br />hereto as Exhibit "B," provided that modifications to said plan may be approved by the Cirv,
<br />as provided by Secrion 41.160.D of the Zonin¢ Code, during the SEPA review w•hich shall be
<br />required prior to issuance of buildine permiu. All requiremenu of the City of Everett Zonino
<br />Code for the B-2 zone shalt apply except as otherwise provided herein.
<br />2. Setbacks. The reaz setback from the east property line shall be a minimum of 2� feet.
<br />The front setback shall be a minimum of 10 feet. Ihe north and south setbacks shall be a
<br />minimum of 10 feet.
<br />3. Signs. The requiremenu of Sign Category B shal! apply, except that pole signs shall not
<br />be permitted.
<br />4. Permitted Uses. The following uses which aze normally permitted in the B-Z zone shall
<br />be prohibited:
<br />Automobile service stations, automotive services, automotive vehicle sales, movie theater or
<br />comples, bowlin¢ alley, private club or lodee, laundromat, bineo hall, financial institutions with
<br />drive up teller or outdoor automatic teller machines, taverns, night clubs, hoteis, motcls,
<br />automobile washing facilities, self service storage facilities, motor vehicle fuel sales in
<br />conjunction with retail uses, social service facilities, retail uses involvine outdoor display or
<br />sales areas, mobilehome or recreational vehicle sales, mo'tuaries, funeral parlors, crematoriums,
<br />skating rinks, equipment rentals, ambulance service, miniature golf course, video game arcades,
<br />trade center and�or exhibition hall, commercial parking or commuter parking facilities,
<br />detoxification centers, Class II group homes, solid waste Vansfer stations, recycling and/or
<br />composting collection centers, minimum risk waste coUection centers, and other uses not
<br />presently :isted in the B-2 zone which Ihe Planning Director determines to be similar in character
<br />and narure to those specified herein as prohibited uses.
<br />5. Building height shall be as required in the B-2 zone except as provided herein. If any
<br />building is proposed which contains more than 2 stories above grade, the use of any story
<br />above the second shall be limited to residential use. Below grade pazking shall not be
<br />considered to be a story.
<br />6. There shall be only one drive approach allowed for ihe subject property, the location of
<br />which shall be approved by the City Traffic Engineer.
<br />7. Construction must be commenced within ihree (3) years of the date of this Resolution.
<br />Construction of buildin�s and of the site improvements required by this Resolution shall be
<br />comp(eted within one year of the date of issuance of buiiding permits. The Planning Director
<br />may authorize an extension of up to one additional year.
