2. 11te proposed rezone beazs a substantial relation to the public health, safety and welfaze;
<br />3. The proposed rezone promotes the best long term interesu of the Everett community; and
<br />4. The terms of this resolution aze sufficient to mitigate the impacts of the proposed rezone.
<br />NOW, THEREFORE, BE I1' RESOLVEL that the City Council of the City of Everett
<br />declazes its intent to rezone property located at 9707 and 9709 19th Avenue SE, a vicinity
<br />map of which is attached hereto as Exhibit "A;' from R-2(A) (Singie Family Attached
<br />Medium Densiry) to B-2 (Community Business), pursuant to the provisions of Secrion
<br />41.160 of Ordinance No. 1671-89, as amended, and the Council shall by Ordinance, effect
<br />such rozone upon being advised that all of the following conditions, stipulations, limitations,
<br />and requiremenu contamed in this Resolution have been met:
<br />l. Development of the site shall be in conformance with the conceptual site plan attached
<br />hereto as Exhibit "B;' provided that modifications to said plan may be approved by the Citv,
<br />as provided by Section 41.160.D of the Zoning Code, during the SEPA review which shall be
<br />required prior to issuance of building permits. All requirements of the Ciry of Everett Zoning
<br />Code for the B-2 zone shall apply except as othenvise provided herein.
<br />2. Setbacks. The rear setback from the east property line shall be a minimum of 25 feet.
<br />The front setback shall be a minimum of 10 feet. The north and south setbacks shall be a
<br />minimum of 10 feet.
<br />3. Signs. The requirements of Sign Category B shall apply, except that pole signs shall not
<br />be permitted.
<br />4. Permitted Uses. The following uses which aze normally permitted in the B-2 zone shall
<br />be prohibited:
<br />Automobile service�stations, automotive services, automotive vehicle sales, movie theater or
<br />complex, bowling alley, private club or lodge, laundromat, bingo hall, financial instih.ttions with
<br />drive up teller or outdoor automatic teller machines, tavems, night clubs, hotels, motels,
<br />automobile washing facilities, self service storage facilities, motor vehicle fuel sales in
<br />conjunction with retail uses. social service facilities, retail uses involving outdoor display or
<br />sales areas, mobilehome or recreational vehicle sales, mortuaries, £uneral parlors, cremacoriums,
<br />skating rinks, equipment rentals, ambulance service, miniature golf course, vid<:o game azcades,
<br />trade center and/or exhibition hall, commercial parking or commuter parking facilities,
<br />detoxification centers, Class II group homes, solid waste tr3nsfer stations, recycling and/or
<br />composting collection centers, minimum risk waste collection centers, and other uses not
<br />presently listed in the B-2 zone which the Planning Director determines to be similar in chazacter
<br />and nature to those specified herein as prohibited uses.
<br />5. Building height shall be as required in the B-2 zone except as provided herein. If any
<br />building is proposed which contams more than 2 stories above grade, the �ue of any story
<br />above the second shall be limited to residential use. Below grade pazking shall not be
<br />considered to be a story.
<br />6. There shall be only one drive approach allowed for the subject property, the location of
<br />which shall be approved by the Clry Traffic Engineer.
<br />7. Construction must be commenced within three (3) yeazs of the date of this Resolution.
<br />Construction �f buildings and of the site improvemenu required by this Resolution shall be
<br />completed within one year of the date of issuance of building permiu. The Planning Director
<br />may authorize an ext..nsion of up to one additional year.
