3) The portions of the on -site and off -site stormwater systems provided to control <br />stormwater run-off generated by the project shall be designed to meet or exceed City <br />standards. <br />4) Provisions for continuous perpetual maintenance, including a maintenance <br />schedule, of the on -site and off -site stormwater system shall be provided to parties to this <br />agreement. The maintenance schedule shall also include a performance requirement for <br />the stormwater systems biofiltering vegetation. The applicant shall be responsible for <br />maintenance of the systems. <br />5) The City shall remain responsible for enforcement of the conditions of the MDNS <br />and the applicant's compliance therewith, including the Washington State Department of <br />Ecology, Section 401 Water Quality Certification. The applicant shall comply with a ten- <br />year bonding and inspection requirement for the off -site mitigation areas. <br />6) Prior to finalizing the proposed landscaping plan and submittal thereof to the City, <br />the applicant shall provide three (3) complete copies of the proposed landscaping plan to <br />SLAC. SLAC shall cause the landscaping plan to be immediately reviewed by its <br />steering committee or other designated group and comments shall be provided to the <br />City. The landscape plan for the 19th Avenue SE gateway corridor will meet Everett city <br />standards and requirements and will include a mix of evergreen and deciduous trees to be <br />approved by the City, grouped and arranged to provide continuity to the gateway plan. <br />7) Traffic ingress/ingress and circulation for the project will occur at one general <br />purpose access point on 19th Avenue SE and one access point on 100th Street SE The <br />curb cut along 19th Avenue SE shall be at the same location as the curb cut on the <br />opposite side (eastern) of 19th Avenue SE which provides joint access for the Burger <br />King restaurant and Les Schwab Tire. An additional "Truck Only" access will be <br />permitted on 19th Avenue near the northerly property line. This access shall be used by <br />delivery trucks only and will be restricted to "right turn out" only. The larger curb cut <br />immediately south of the "Truck Only" curb cut will be for the project customers and will <br />be restricted to right turn in and left and right turn out. The curb cut at 100th Street SE <br />will have full access and will provide ingress and egress for all vehicles requiring access <br />to the project.
