This Declaration of Reciprocal Easements is made and entered into this _day of May, 1997, by W.P.L <br />NO. 1, LLC, a Washington Limited Liability Company; and, W.P.I. NO. 2, LLC, a Washington Limited <br />Q Liability Company, (collectively the Owner), referred to as "Declarant". This instrument is, for convenience, <br />hereinafter referred to as "Declaration". <br />*1 RECITALS: <br />A. Declarant is the owner of certain real property in the County of Snohomish, State of Washington. <br />Legal descriptions of said real property arc attached hereto as Exhibit "A" and by this reference incorporated <br />L herein (hereinafter "Total Parcel"). <br />R. The Total Parcel is composed of four commercial building lots. <br />C. Declarant desires to provide reciprocal easements for the usage of the Common Areas of Lots 1- <br />A, 1-B, We East 30 feet of 2-A, and 2-B, (collectively, the "Lots") as depicted on Exhibit "B-1 & B-2" and by this <br />reference incorporated herein. "Common Area" as used in this Declaration, means all areas not covered by any <br />building, any expansion, any reconfiguration, or any remodel thereof. These areas are to be used in common for <br />access, circulation, utilities, landscaping and maintenance. <br />As used in this Declaration, "Owner" means any party (s) having an ownership interest in any of the Lots. <br />"Tenant" means any tenants and subtenants granted a possessory interest in any of the Lots and their agents, <br />customers, business invitecs, employees and occupants of the buildings on the Lots, subject to the provisions and <br />restrictions set forth below. <br />NOW, THEREFORE, Declarant hereby declares that the Lots shall be held, used, and conveyed subject to <br />this Declaration on the following terms: <br />1. Common Access, Circulation Easements. Each Owner and Tenant of any of the Lots shall have the <br />non-exclusive right to use in common the access Hays on the Lots for ingress and egress, circulation, and <br />pedestrian traffic to and from the Lots. No fences, walls and barriers to access shall be erected on the access ways <br />on the Lots that would unreasonably interfere with use for ingress and egress among and between the Lots without <br />all Owners' prior consent. <br />1. Use ojAccess Wad With rospect to the access ways on its own Lot, each Owner and Tenant will be <br />free to construct, maintain, improve, repair and reconstruct utility lines over, under or across such access ways <br />where such uses do not unreasonably interfere with ingress and egress.
