These easements shall be perpetual in duration and shall run with the land. <br />& Successors and Assrrrrs. All the terms and conditions of this Declaration shall nun with the land and <br />shall inure to the benefit of, and be binding upon, the successors and assigns, or personal represenatives and heirs <br />of the parties herein, including, all subsequent Owners of each Lot. <br />9. &Movement The respective Owners of each Lot shall have the right to obtain a court decree <br />specifically enforcing the terms of this Declaration, including payment obligations. In the event of a lawsuit in <br />connection with the enforcement of the easements, prevailing parties shall be entitled to an award of reasonable <br />attorneys' P;s and costs including fees and costs in any appeal. <br />10. Waiver. Failure at any time to require performance of any provision of this Declaration shall not <br />limit a party's right later to enforce the provision. Any waiver of any breach of any provision shall not be a waiver <br />of any succeeding breach or a waiver of any provision of this Declaration. <br />11. Indemnities. Each Owner shall defend, indemnify and hold the other Owners harmless from any <br />claim, loss or liability arising out of or in connection with, the Owner's own negligence or failure to comply with <br />the terms, restrictions and provisions of this Declaration. <br />12. pffed ofInvaudadon.
