ICelley to consuuct a <br />720 squnre foot detached garage within a 150 foot stream buffer at 10314 19��' Place W with the <br />following conditions: <br />pW✓1. �nhance tlie area to the east of the existing fence as shown on the buffer enhancement plan by <br />Wetland Resources, Inc. dated October 5, 2010. In addition, remove the existing 11' x 20' <br />concrete parking pad and replant with grass or other vegetation. �nl�ancement must be completed <br />prior to issuance of buifding permits or may be completed after issuance of building peimits if an <br />assnrancc device worih 300% of the cost of planting is provided to the City of Everett. <br />0�J 2. The existing six foot solid board fence nlong the rear lot line, as shown on the approved buffer <br />e�iliancement plan, must remain. Two Critical Area signs must Ue placed on the fence. They are <br />available for purchase at the City of �verett Permit Counter. <br />��3. Provide a recorded Critical Area Protective Coveuant designnting tlie buffer prior to issuance <br />ofthe building penuit. <br />4. Roof runoff fi•oru the new structure must be dischaiged to drywells nt the corners of the gcu�age <br />fi�rthest from the detention pond. <br />SuUsection 37.170.0 of the City of Everett Zoning Code gives die Planning Director the authority tr <br />reduce the standard strenm buffer width up to SO% only when there has previously been substaatial <br />legll alterltion of Uie stremn's buffer on thc subject lot or adjoining lots resulting in the existing <br />buffer Ueing unvegetuted, sparsely vegetated, or vegetnted with invasive species and when the <br />remaining Uuffer is eiiliauced sufficient(y to improve the functional values of the buffer. The <br />Plnnning Director Approved thc reduced buffer based upon information contained in a study prepaz•ed <br />by WeAnnd Resources,lnc. iticluding the following: <br />1. The suUject property �sas developed witl� a single family residence within the plat of Fairmont <br />Eslalcs Division No. 2 in the early 1980s which predates current critical area regulations. Swamp <br />Crcelc is located approximately 80 feet west of tlie subject properiy within Track 999. Between <br />the subjcct propeity nnd the creek, is a maintained detention pond vegetated primarily with grass, <br />two yoang cedar trees and Ulack cottomvood trees. The backyard of the suUject property and the <br />pond are iu thc 150 foot strenm buffer. Tlie backyard has been mair.taiued with lawn and a <br />garden. City maintenance standards of tlie pond require the grass and odier vegetation to be <br />regularly mowed except for thc hvo cedar trees and black wttonwoods. <br />2. According to the report by �Vetland Resources, Inc., llie location of the detention pond in relation <br />lo tlie strcam and the buffer on Uie suUject site, water quality functions provided by the <br />mnintaincd lawn have litde or no effect on Swamp Creek.
