.� � <br />JOINT DEVELOPMENT AGREEMEN7 <br />GP,NNT �F pRIVATE UTILITY EASEMENT <br />AND FIRST RIGHT OF REFUSAL <br />Everett, Washington <br />THIS IS a Joint !'�z�,elopment Agreement. The parties to this agreement <br />are CRAIG A. JOHNSON, a single person, hereinafter referred to as Johnson; <br />and DALLAS R, OLSON, JR., a single person, and C. J. �BERT, a single person, <br />hereinafter referred to as Olson and Ebert. <br />RECITALS <br />Johnson is the owner of certain real property described as the ;"ast 75 <br />feet 5 inches of Lots 53 and 54 of Block 372 of the Plat of Everett, Division <br />G, recorded in Volume 1792 of Plats of Snohomish County at Page 1276, records <br />of Snohomish County, Washington. <br />, Olson and Ebert are the contract purchasers of certain real property <br />4 which adjoins on the West the rea� property of Johnson, �escribed above. The <br />a <br />real property being purchased on contract by Olson and Ebert is described as <br />Lots 53 and 54 of Block 372 of the Plat of Everett, Division G, recorded in <br />Volume 1792 of Plats of Snohomish County, at Page .1.276, records of Snohomish <br />� County, Washington, LESS the East 75 feet 5 inches of said Lots 53 and 54. <br />� Olson and Ebert plan to develop the property which they are purchasing. <br />It is to the mutual benefi� of Johnson and Olson and Ebert to cooperate in <br />the development of the above-described properties owned by each of them. <br />AGREEMENT <br />IN CONSIL`ERATION of the mutual promises and covenants cuntained herein, <br />the par+:ies agree as follows: <br />Johnson does hereby grant to Olson and Ebert, their agents, successors <br />and assigns, the right to perform grading, sloping, and filling on the <br />portion of the property owned by Johrison approximately described as: The <br />West 20 feet of the East 75 feet 5 inches of Lots 53 and 54, as described <br />above, (that area lying to the West of the existing structure located there- <br />on? hereinafter referred to as "fill area." Johnson does aiso hereby grant <br />to Olson and Ebert, their agents, successors and assigns the right to ingress <br />and egress over and across the fill area for the purpose of grading, sloping <br />and filling. Johnson further grants to Olson ar�d Ebert the right to relocate <br />the existing sewer line within the fill area as deemed necessary by Olson and <br />Ebert.
