�i .- <br />� �, <br />�xh � b� � <br />Finding: The existing house was built in 1915, the church in 1935. The east 30 <br />X 50 feet of the lot with the existing house was sold by a real estate contract in <br />1968 (Recording # 2060825). The segregation was prior to November 2, 1975 <br />but did not meet Zoning Code Requirements. Therefore, the segregation did not <br />comply with the Tax segregation process. <br />Conclusion: A tax lot that does not :;omply with the condition above may �a <br />approved by the Hearing Examiner per EMC 18.28.010. B. <br />2. An application to ihe Hearing Examiner for a variation may be made as set forth <br />in EMC 18.32.010. When considering the variation; the Hearing Examiner rnay <br />consider as an "exceptional circumstance or condition" for purposes �f Section <br />18.32.010 D.1 which reads "There are exceptional circumstances or conditions <br />such as: location of existing structures; lot configuration; topographic or unique <br />physical features that apply to the subject property which prohibit the applicant <br />from meeting the standards of this article." When considering the application, if <br />appropriate for the subject property, the Hearing Examiner may consider whether <br />the information provided by the applicant was complete and accurate. <br />Finding: The house and church on the site were legal non-conforming uses <br />and structures. The building, electrical and utilities permits issued for the <br />existing dwelling were not procured by misrepresentation of the conditions of the <br />site. Since the tax segregation in 1968, the singfe family house has been used <br />as a separate dwelling from 1968 to 198II and 1997 to present. <br />Conclusion: Since the property was tax segregated in 1368, the Nroperty <br />has been used as a single family dwelling. The issuance of permits was not <br />pr�cured by misrepresentation of the conditions of the site.
