If the City Council is successful in its s�it, the <br /> , 4 respondent shall bear the rosts of the action, including reasonable <br /> 9 attorney fees. <br /> ( The failure or refusal of the City to enforce any provision of this <br /> � ordinance, and as hereafter amended, shall not constitute a waiver or <br /> g bar to prevent enforcement ,thereof against any person for a subsequent <br /> 9 violation hereof� or for any other violation by anx other person. <br /> 10 Section 14 : Proteetion of Public/Private RiQhts <br /> 11 Implementation of any provision of this new Chapter to the Everett <br /> 12 Municipal Code shall not cause nor be construed as an infringement of <br /> 13 the rights of individuals, municipalities, or corporations other than <br /> 14 the developer seeking a permit or approval as described in Section 3• <br /> 15 Seetion 15: Effective Date j <br /> 16 The requirements of this chapter shall apply to all plats receiving <br /> 17 preliminary approval subsequcnt to May 1�, 19�8.
