The zoning <br /> code defines the rear yard "ss an open space extendiny across <br /> the full width of the lot, the required depth of whi^h shall <br /> be measured horizontally from the rear lot line to a line <br /> parallel thereto on the lot" . <br /> The side parallel to lOth Dr. is considered to be the length <br /> of the lot since that side is longer than the side that is <br /> parallel to 109th St. According to the zoning code, the front <br /> yard setback is 20 feet in depth from the £ront 1ot line that <br /> is parallel with 109th. The site plan that was submitted, <br /> shows that the rear yard (opposite of the front yard) does not <br /> meet the required 20 foot setback . The side yard that is <br /> parallel and adjacent to lOth must have a 10 foot setback . <br /> See the enclosed site plan showing the required setback lines <br /> £or the lot #26 . <br /> Until a new site plan with the required setbacks is submitted, <br /> the building permit cannot be approved .
